There has never been Sworn Interpreter in Indonesia, at the beginning was initiated by Governor DKI Ali Sadikin at the time Foreign Investment was an important issue require Sworn Translator in Jakarta for English Chinese Japanese Korean Arabic German France Dutch Russian Vietnamese Thai and as time went by people start asking legality and appropriateness of the Governor issuing such Decree then for the last 3 (three) years there is no Decree from Governor of DKI Jakarta appointing Sworn Interpreter in Indonesia. The only association is HPI with only individual member, where most corporate they are looking for a company who will responsible for the quality of rendered service and we are now in pursue to become overseas members of Association of Sworn Interpreter in UK and Europe, we have complied all requirements. Most probably in future the Decree will be issued by Ministry of Law and Human Rights of the Republic of Indonesia. Up to now in our Penal / Crime Code (KUHP) there is no word “Sworn” translation, but all foreigner (non Indonesia Passport Holder) have their rights to be accompanied by Sworn Interpreter, Government is obliged to provide one. We  in can issue Assignment Letter to our Interpreter and presenting formal Identity of the Interpreter and Business Permit (SIUP) for translation. Upon examination, interpreter will sign Minutes of Sworn Translation and attached in Minutes of Police Examination.

Prior to Court Trial, Panel of Judges will ask Interpreter to present all supporting doc and ID in original and submit copies to Court Registrar/Clerk (Panitera), then interpreter shall be asked to take an Oath according to his/her religion (Personal Believe, temporary cannot be accommodated in Court), Sworn Interpreter shall formally dressed (long sleeves Shirt & Tie for Male and Blazer for female with no revealing sensuality). Sworn Interpreter are NOT necessarily friendly with any parties, and shall strictly limit to the impartial assignment, no matter what Advocate, Solicitors, Legal Councilor suggest. Sworn Interpreter shall NOT give personal opinion nor conclusion of the interpretation, unless asked by the Law Enforcement Authorities (Police, District Attorney, KPK, Judge etc). Especially in Police examination, repeated same question at different opportunities are part of Police tactical strategy. Interpreters are NOT to question method of Police examination, instead simply interpret same question(s) exactly as asked. Not only the answer, but the way Reporting / Reported parties responding the question has specific meaning to the police. For Witness, presences of Lawyers are not requiring by law, unless under threat of above 5 years imprisonment, however it is Police discretion allowing Lawyers to be present. Police shall listen (take note) of what is said and translated by interpreter, not by Lawyer. All foreigner (non Indonesia Passport Holder) are obliged to be accompanied by Sworn Interpreter. English (or any other foreign languages) speaking Lawyer can only choose one function at the same time. They are not allowed to function as both. No whispering with anyone at Trial session of Court Justice, every word he/she heard shall be interpreted out loud, and address Panel of Judges as Your Honor.
